These Terms and Conditions (“Terms”) govern your access to and use of the Precision Stone Design website and the services provided by Precision Stone Design (“Company,” “we,” “us,” or “our”). By accessing this website, requesting a quote, or engaging our services, you agree to be bound by these Terms.
- Services
Precision Stone Design provides design, fabrication, and installation services for stone and other hard surfaces, including but not limited to countertops, wall applications, fireplaces, and related architectural surfaces for residential and commercial projects.
All services are subject to availability, site conditions, and acceptance of a written proposal or contract.
- Estimates and Proposals
- All estimates are non-binding until confirmed in a written proposal or contract.
- Measurements, drawings, and material selections must be approved by the client prior to fabrication.
- Any changes requested after approval may result in additional costs and schedule adjustments.
- Materials and Natural Variations
- Natural stone and similar materials inherently vary in color, veining, texture, and pattern.
- Samples and images are representative only and do not guarantee an exact match.
- Minor surface imperfections are considered acceptable industry standards and do not constitute defects.
- Client Responsibilities
Clients are responsible for:
- Providing accurate site access and ensuring work areas are ready for installation.
- Verifying measurements, layouts, edge profiles, cutouts, and material selections prior to fabrication.
- Ensuring cabinets, substrates, and supporting structures are level and capable of supporting the installed surfaces.
Precision Stone Design is not responsible for delays or issues caused by site conditions outside our control.
- Payment Terms
- Payment terms will be specified in the applicable proposal or invoice.
- Deposits may be required prior to fabrication or installation.
- Final payment is due upon completion of installation unless otherwise agreed in writing.
- Late payments may be subject to interest, collection costs, or suspension of services.
- Cancellations and Changes
- Orders canceled after fabrication has begun may be subject to charges for materials, labor, and restocking.
- Schedule changes requested by the client may result in additional fees.
- Warranty and Disclaimers
- Precision Stone Design warrants its workmanship for a period of one (1) year from the date of installation, unless otherwise stated in writing.
- During the warranty period, Precision Stone Design will, at its discretion, repair or replace workmanship-related defects reported in writing by the client.
- Callback or service visits resulting from normal wear, improper use, lack of maintenance, chemical exposure, impact damage, structural movement, or work performed by others are not covered under this warranty and may be billable.
- Manufacturer warranties apply to materials where applicable and are subject to the manufacturer’s terms and conditions.
This warranty does not cover damage caused by misuse, neglect, accidents, acts of nature, excessive heat, moisture intrusion, or improper maintenance. Except as expressly stated, services are provided “as is” without warranties of any kind, express or implied.
- Installation Completion and Acceptance
- Installation is deemed complete upon substantial completion of the agreed scope of work.
- The client or client’s representative is responsible for inspecting the work upon completion.
- Any visible or cosmetic concerns must be reported in writing within 48 hours of installation.
- Failure to report such concerns within this timeframe constitutes acceptance of the installation.
- Precision Stone Design is not responsible for conditions or damages discovered after installation that were not reasonably visible at the time of completion.
- Limitation of Liability
To the fullest extent permitted by law:
- Precision Stone Design shall not be liable for indirect, incidental, consequential, or special damages.
- Total liability shall not exceed the amount paid by the client for the specific services giving rise to the claim.
- Force Majeure
Precision Stone Design shall not be liable for delays or failure to perform due to events beyond its reasonable control, including but not limited to acts of God, weather conditions, material shortages, transportation delays, labor disputes, governmental actions, or utility interruptions.
- Intellectual Property
All website content, including text, images, designs, logos, and graphics, is the property of Precision Stone Design and may not be used, reproduced, or distributed without prior written consent.
- Mechanics Lien Notice
Pursuant to Illinois law, Precision Stone Design reserves the right to file a mechanics lien against the subject property for unpaid labor, materials, or services. The client acknowledges that failure to remit payment in accordance with agreed terms may result in lien rights being exercised as permitted by law.
- Website Use
You agree not to:
- Use the website for unlawful purposes.
- Attempt to interfere with the website’s functionality or security.
- Submit false or misleading information.
We reserve the right to modify or discontinue the website at any time without notice.
- Privacy
Use of this website is also governed by our Privacy Policy. By using the website, you consent to the collection and use of information as described therein.
- Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to conflict-of-law principles.
